We place special emphasis on providing our clients with advice and assistance thanks to a timely and efficient management of litigation, both by seeking solutions through negotiations and concentrating our efforts for the best possible outcome of any contentious matter, evaluating together with the client the costs and benefits of undertaking litigation.
In particular, we assist our clients with litigation in a broad range of commercial and corporate matters, including those relating to director’s liability, unfair competition, product liability, insurance, insolvency situations and insolvency proceedings, intellectual property rights and trademark and patent infringements; we also undertake debt recovery work for some of our main clients.
We place our experience at the service of each client from the perspective of both substantive and procedural law, so as to ensure an approach that is always tailored to the client’s business dynamics.
Our firm is also able to protect and represent the interests of our clients – be they Italian or foreign – both in judicial disputes in Italy and in cross-border litigation cases, also thanks to a well-established network of foreign correspondents and the members of the firm who are qualified to practice abroad; which allows us to provide our clients with highly qualified and professional assistance in relation to any proceedings be they before the Italian or foreign courts.
Arbitration has always been part of the DNA of Cartwright – Pescatore. We assist our clients in a variety of international arbitration proceedings, in particular, those in civil and commercial matters before the International Chamber of Commerce (ICC), the Milan Arbitration Chamber, the China International Economic and Trade Arbitration Commission (CIETAC), as well as before the London Court of International Arbitration (LCIA). On numerous occasions we have successfully achieved out-of-court settlement of the disputes, including disputes of a significant value.
We frequently advise our clients, both in drafting and negotiating contracts, on how to resolve any disputes and on the choice of forum.
