On April 23, 2024, EU Regulation No. 1143/2024 was published, reforming the sector of Geographical Indications within the European Union with reference to the regulation of wines, spirits, agricultural products, and the agri-food sector (hereinafter referred to as “GIs”). This Regulation formally entered into force 20 days following its publication but applies starting from 13th May 2024.
For the first time, the Regulation consolidates into a single legislative text the rules governing GIs, thereby unifying the regulatory framework of a field previously governed by numerous statutes, with the aim of enhancing sustainable integration into the European quality system and strengthening the position of GI producers throughout the entire supply chain.
This initiative is part of a broader process initiated by the European Commission in 2022, which, recognizing the increasing importance of GI product regulation in recent years, identified the need to revise the reference legislation. This revision was placed among the goals of the Green Deal as an integral part of the Farm to Fork strategy.
The European legislator has introduced numerous innovations with this Regulation, and the main changes include: (i) the promotion of collective action among operators; (ii) the strengthening of the powers and tools available to Consortia for protection; (iii) the extension of online protection for GI-branded products; (iv) the simplification of the registration of new designations and the control of the internal market.
At the core of this legislation is the European legislator’s desire to ensure fair competition and to increase consumer awareness of the value of GI products in the production and distribution chain, implementing a policy of transparency aimed at providing consumers with clear and guaranteed information.
