The time limit for the resumption of legal proceedings, interrupted pursuant to art. 43 of the italian insolvency law by a declaration of bankruptcy, could starts to run from the moment when the party not affected by the event has had actual knowledge of the insolvency proceedings. This happens, for example, when the part has filed or sent application to clam its credit to the receiver.
